船主T.C.

Davis,
I am responding in bullet points for simplicity
Sent email requesting information on boats
You replied with a the suggestion of boat you were familiar with #4278
I read and reread you ads and also found other listings of the same boat with similar descriptions.
We had a few conversations with your assuring me the boat was perfect " In the showroom"
Being "in showroom " i felt was important
I made offer $20k
you replied owner refused
I countered $ 22k owner refused
A week later, you contacted me/ owner accepted
Stipulation delivery had to be in 4-5 weeks
We had a few converesations about payment, I offered to pay in full but you emphasized full payment later
My expirience tells me he was probably stalling for another offer
Conversations for the pick up date and times was peculiar because where the boat was located ( I thought it was in showroom)
You told me when to pick up boat
I called and asked TO MAKE SURE BOAT WAS STARTED, WITH FLUIDS ECT PRYOR TO SHIPPING.
Thats when things fell apart. You emphasized "as is" and I emphasized the advertisement stated ready for use. This is a very basic request.
You called back and stated "YOU WILL COMMISSION THE BOAT" stating it would be a week or so.
You had specified very specific "SINGLE DAY" I could schedule pickup and the shipper was on route
You assured me the engine was rebuilt in 2013 and ran for minimal hours after that. Also the boat had been "WINTERIZED" suggesting that ensures its condition
Without having many options ( shiper scheduled next day) I volunteered to have it shipped and have my marina start it up with the understanding if the was an issue I'd call you. ( I was assuming it shouldn't be a problem)
Boat delivered to highly qualified, reputable boat shop.
T.C. Sweeney, Owner, called me very concerned with the product use for winterization. He added new batteries, cleaned up connections, bilge pumps, new flush tube system, checked fluids and it did start up easily. He ran it briefly and it did seem ok.
Being rebuilt in 2013 with minimal hours after that, being winterized and your assurances, I did not have them change any filters or further analysts. The invoice was $1500.
I had sprinkler under the hull for about 2 days straight.
I brought boat to ramp, leaving on trailer, for 5 hours 4 days straight, I left in water.
When I removed, the hull was pouring out water everywhere!, aft corners, propellar shaft , EVERYWHERE
I called you, explained and you8 suggested I soak it longer and assured me " IT WILL " swell up.
I soaked on ramp for 10 days with minimal improvement.
Not believing you would take responsibility, I sucked up. Had the actual cracks in hull, not gaps eposed and the entire interior hull was sealed. ( NOT THE OPTIMUN CHOICE !!!)
Finally was able to drop in, with much added stress to me.
The boat did start up easily and sounded good.
Being familiar with vintage boats, I was very careful to warm up engine and not push it on maiden voyage.
I was carefully running it, sounded very good but after about 15 minutes I noticed oil pressure gage maxed out. The red light was not on and the thermostat was good. I did not get a smell but I pulled over. I looked at engine and did not see anything unusual, waited about 30-40 minutes. Started no problem, 10 minutes out, oil gage at 0, then engine lost power, then died. I was taking on water and extremely concerned. I had to try to start for pumps and barely made it to shore. The interior had taken on a ton of water and a disaster. With great difficulty, stress, expense and embarrassment, I got it back on trailer.
Brought it back to shop. TC found the copper line going to oil filter had snapped at the connection point. ( he said sometimes they tighten them to much?)
I have lost the entire spring and special occasions I was planning to use it. I expect you take responsibility.
Please lmk asap
